1. ABOUT THIS DOCUMENT
This document sets out our general terms governing use of our website Exact-Tours.ro (hereinafter referred to as the Site). These terms cover all of our websites, including those at the following addresses: https://exact-tours.ro/ja/, https://exact-tours.ro/es/, and https://exact-tours.ro/fr/.

Please read these terms and conditions carefully before using our sites. Accessing and using this websites represents your automatic acceptance of the Terms and Conditions of Use of the Site.

If you do not agree with these terms and conditions, then you must not use our sites.

3. BOOKING CONDITIONS
3.1. CONCLUSION OF TRAVEL CONTRACT
With your booking you are agreeing to enter a binding travel contract with Exact Tours. The travel contract comes into effect when we issue our acceptance (details below, in the ACCEPTANCE OF BOOKING AND FINAL PAYMENTS section below).
Please note that your booking is for you as well as for all the people travelling with you. You are answerable for your obligations in respect of this contract as well as other people travelling with you.
The contract will contain all important details and information on the holiday fees and services included in the tour price.

3.2. DEPOSIT REQUIREMENTS
Except as set out in the details of each tour, you are required to pay a deposit of 30% per trip for your booking to be confirmed. If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking.
Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the service contract.

3.3. ACCEPTANCE OF BOOKING AND FINAL PAYMENTS
After accepting your booking, a booking confirmation invoice will be issued and a contract will exist between you and Exact Tours from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment.
Payment of the balance of the trip price is due 30 days before the departure date, except as otherwise set out in the service contract. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined in the service contract will apply.

3.4. PRICES AND SURCHARGES
Our tours are subject to variable and seasonal pricing, which are standard practices within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability.

3.5. CANCELLATION BY YOU
If you cancel some or all portions of your booking the cancellation terms set in the service contract will apply. A cancellation will only be effective when we receive the written confirmation that you have sent to your relevant sales representative.

3.6. CANCELLATION BY US
Our trips are guaranteed to depart unless the minimum group size (specifically stated in the Details section of each tour) has not fully paid or when Force Majeure results in the cancellation of a trip. If we have to cancel your trip, we will tell you as soon as possible and will proceed to compensate you in accordance to the existing service contract.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

3.7. REQUIRED INFORMATION
For us to confirm your travel arrangements, you must provide all requested details. Necessary details vary by tour; they usually include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements.

Travelers are responsible for obtaining any documents required for their participation in the tour such as a valid passport, all visas, vaccination certificates, insurance and any other documents. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the traveler’s responsibility and additional costs will apply.

When completing any enquiry, booking or other forms on our website, some information is mandatory before you will be able to submit the forms to us. Mandatory information requirements are clearly identified and are denoted by an asterisk (*). Where any information is not marked with an asterisk then such information is optional.

When you submit any information to us, including in connection with a registration, enquiry or booking, you must ensure that it is true, accurate, current, and complete in all respects, and you represent that it is. We will rely on your information provided.

3.8. LIABILITY
Liability is limited to the price of the tour that is subject to the damage claim. Exceptions can be set in certain tours and will be specified in the service contract.
The claim must be submitted to Exact Tours in writing, by email, no later than 4 weeks after the end of the trip; otherwise it will be forfeited.

Exact Tours is not liable if the non-performance or bad performance of the contract is due to:
a failure to act on the side of the customer;
an unforeseeable and unavoidable omission by a third party, which is not involved in providing the contractually agreed services;
force majeure or an event, which Exact Tours or a service provider could not have foreseen or avoided, notwithstanding the exercise of due care.
Exact Tours therefore is not liable for changes in an itinerary caused by strikes, social unrest, weather conditions, decisions taken by the authorities, third-party delays, etc., or for changes in schedule due to flight schedule changes.

4. CHANGES TO OUR SITES
Although we make reasonable efforts to update the information on our site, we cannot guarantee that the content on our site is accurate, complete or up-to-date. We shall be entitled to change our website content from time to time, without notice, and for any reason.

There may be mistakes and errors in our website content which we fail to notice, which will not be binding on us. We reserve the right to correct any errors at any time without notice. If any correction affects any booking or order you have submitted to your material detriment, then we will give you the opportunity to cancel the booking.

5. CHANGES TO THESE TERMS
We may revise these terms of use at any time by amending this page. Please check this page from time to time to take notice of any changes we make, as they are binding on you.

6. INTELLECTUAL PROPERTY
The material contained on our websites (tours, design, text and graphics) is owned or licensed by us and are protected by national and international intellectual property laws, including copyright. You may use our websites only for your personal and non-commercial purposes.
Your use of our websites must not in any way infringe the intellectual property rights of any person in any jurisdiction.

You must only use this Site for lawful purposes and in a responsible manner. Any breach of these Terms by you will result in legal action being taken by us against you.

7. FORCE MAJEURE
We will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Terms and Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid.

8. APPLICABLE LAW AND DISPUTES
These terms and conditions and the relationship between customers and Exact Tours Ltd. is governed exclusively by Romanian law, and you must bring any claims against us exclusively in the courts of Romanian.
